Section 31(a) of the State Department Basic Authorities
Act as amended by Public Law 96-465 (the Foreign Service Act of 1980), invests
in the Secretary of State the authority to authorize and assist in the
establishment, maintenance and operation by civilian officers and employees of
the Government of non-Government-operated services and facilities at posts
abroad, including the furnishing of space, utilities, and properties owned or
leased by the Government for use by its diplomatic, consular, and other
missions and posts abroad. The provisions of the Foreign Service Buildings
Act, 1926 (22 U.S.C. 292 - 300) and Section 2684 of this title may be utilized
by the Secretary in providing such assistance.

Employee associations shall operate under a charter
approved by the Assistant Secretary for Administration of the Department of
State. (See 6 FAM 551.)

These regulations are applicable to the operation of
non-Government-operated employee associations abroad. They do not apply to
emergency commissary and mess services authorized under Section 31(b) of the
State Department Basic Authorities Act, as amended.

6 FAM 514.1 Department of State

a. The authority vested in the Secretary of State under
Section 31(a) of the State Department Basic Authorities Act, as amended, is
hereby delegated to the Assistant Secretary of State for Administration for
overall administration and oversight of employee associations.
b. The Office of
Commissary and Recreation Affairs, under the guidance of the Deputy Assistant Secretary for Operations will
provide overall policy, operational guidance, and oversight to employee
associations abroad. The board of directors of the Central Commissary and
Recreation Fund shall act as an advisory body to the Deputy Assistant Secretary
for Operations in discharging these responsibilities.
c. The principal officer
at each post or designee thereof (who must be a direct hire U.S.
Government employee) is responsible for monitoring the activities of the
employee association to ensure compliance with Departmental directives and to
protect the interests of the U.S. Government.

When the Department of State principal officer has
authorized the establishment of an employee association, the USAID mission
director or the USAID representative is authorized
to provide assistance in establishing the association, and, as appropriate, to
support the association including the furnishing of space and utilities, and,
on a loan basis, vehicles and other personal property (other than cash) not
required for official purposes. The principal officer will make the determination
as to whether or not the U.S. Government must be reimbursed by the employee
association. Provisions of financial assistance, other than personal property
and personnel, or the establishment of separate or additional facilities, must
have prior USAID approval as applicable.
6 FAM 515 CENTRAL COMMISSARY AND RECREATION FUND

a. Pursuant to the provisions of Section 31(a) of the
State Department Basic Authorities Act, as amended, a Central Commissary and
Recreation Fund has been established in the Department to assist in the
establishment, maintenance, and operation of non-Government operated post
employee associations abroad. The Central Commissary and Recreation Fund is
capitalized by direct assessments against employee associations under such
conditions and procedures as may be determined by the Board of Directors of the
Central Commissary and Recreation Fund, by voluntary contributions from
employee associations, and by other gifts or donations. The purpose of the
Central Commissary and Recreation Fund is to provide financial assistance,
primarily in the form of loans, to employee associations abroad and support the
operations of the Office of Commissary and Recreation Affairs (A/OPR/CR), including the monitoring of
associations activities to ensure that they are in compliance with the charters
approved by the Department; the development of standardized support systems
(i.e., accounting systems, reporting formats, operating procedures, and
internal controls); the provision of TDY on-site assistance; the organization
of regional conferences; the location of insurance and bonding firms; and the
preparation of employee association training manuals.
b. The Central Commissary and Recreation Fund is
administered by a Board of Directors consisting of the Deputy Assistant
Secretary of State for Operations (Chairperson), the executive directors of the regional
executive offices in the Department of State, and one representative each from
the Agency for International Development (USAID), Commerce (FCS), Agriculture
(FAS), and Defense (DOD).
c. The Chair or designee of the Board of Directors of the
Central Commissary and Recreation Fund must engage an independent public
accountant or an independent public accounting firm to conduct an audit each
year.
d. Requests for financial assistance or for policy
guidance may be made to the Central Commissary and Recreation Fund, addressed
to the Office of Commissary and Recreation Affairs (A/OPR/CR).
