12 FAM 351 SCOPE AND AUTHORITY
12 FAM 351.1 Policy

The Bureau of Diplomatic Security (DS) develops policies and programs requiring all new construction or renovation
projects in facilities abroad under chief of mission (COM) authority to comply with Department
Construction Security Standards, Procurement, and Transit Security of
Construction Materials for Controlled Access Areas (CAAs) Standards, and other standards as
appropriate. The Office of Security
Management (OBO/CFSM/SM) is responsible
for implementing these policies and programs.

Legal authorities include:
(1) The Omnibus Diplomatic Security and Antiterrorism
Act of 1986, 22 U.S.C. 4801 et seq.; and
(2) Section 402 of the Diplomatic Security Act, 22
U.S.C. 4852 (states requirements for the Diplomatic Construction Program).

a. DS develops security
standards based on the technical intelligence threat level, for application to
construction security standards, procurement,
and transit security of construction materials for new CAA for new construction or renovation
projects (see 12 FAH-6
H-300). Construction security plans
for relevant new construction and renovation projects must apply these standards.
b. OBO/CFSM/SM implements construction security standards
for all projects to include:
(1) OBO initiates;
(2) A tenant agency sponsors and that take place in OBO-controlled space; or
(3) The post initiates with OBO funding or procurement
assistance.

a. For all new construction or major renovations
involving a CAA, OBO, in consultation with
DS, assigns a direct-hire employee or
DS-approved personal services contract (PSC) employee as a site security
manager (SSM). The SSM, in consultation with the OBO project director (PD), has direct responsibility and authority
for ensuring the security integrity of the site in accordance with the
construction security plan.
b. For most new construction and major renovation
projects, OBO trains and deploys an SSM. The SSM is part of the on-site
OBO project management team and reports to the OBO PD. The SSM keeps the PD and the posts regional
security officer (RSO), who is the
senior DS representative in country, apprised of all security-related issues.

OBO/CFSM/SM prepares
construction security plans for projects initiated
or controlled by the Department, and the Physical
Security Division (DS/PSP/PSD) approves them for
subsequent certification action. Once the
project is certified, work may proceed within facilities containing controlled access
areas. Tenant agencies prepare proposed plans for their agency-sponsored projects and forwards them to OBO/CFSM/SM for review. OBO/CFSM/SM then forwards the
plan to DS/PSP/PSD for approval.

a. Post-specific
noninspectable materials designated for
the CAA require transit security; also,
depending upon the technical threat level, inspectable
materials require transit security when post cannot use DS-approved methods to inspect them (see 12 FAH-6
H-311.15, 312.15, 313.15, or 314.15).
b. Classify as Confidential
all communications that link materials to a CAA, in accordance with the Secure Procurement for
CAAs Standards (see 12 FAH-6 H- 311.13, 312.13,
313.13, or 314.13).
c. Materials are considered secure when U.S. citizens with clearance equal to or greater than
the materials' classification level continuously control them, or when technical devices approved
and installed by DS continuously monitor them.

Plans

a. Include a general
transit security plan in the construction security plan. Transit security
plans may stand alone when they address the shipment of materials, items, or
equipment for a CAA and do not relate to a construction project.
b. The Certification,
Accreditation, and Transit Security Branch (DS/PSD/CAT)
must approve specific plans pertaining to
individual shipments.

a. Containers must remain
operable and meet minimum serviceability requirements that DS/PSD/CAT determines and approves. Obtain
exact and specific container requirements
from DS/PSD/CAT when formulating the
construction security plans for projects.
b. The shipper prepares containers
for installation of technical devices as DS/PSD/CAT
instructs. Furnish these instructions
to the originator/shipper in the construction contract.
c. When
DS/PSD/CAT-trained certification officers install
technical devices in the container, they
certify the container.

When DS/PSD/CAT-trained
individuals remove technical devices, they
decertify the container.

a. A certified shipment
is compromised if:
(1) Control is lost;
(2) The shipment
deviates significantly from the approved transit security plan; or
(3) The transit security
technical safeguards indicate evidence of tampering.
b. An escorted shipment is compromised if the shipment is out of the physical custody or
direct observation of the escort personnel for any amount of time.
c. Noninspectable materials from a compromised secure shipment must not enter a
CAA. Inspectable materials may enter and operate
in a CAA, or reside in a secure
storage area, if authorized by DS/PSP/PSD.

Reporting

Personnel who suspect compromise
of a shipment must report that information immediately to the DS
Command Center (DS/TIA/CC), DS/PSP/PSD,
and OBO/CFSM/SM. If the compromise occurs at a foreign post, personnel must report
it immediately to the OBO project SSM and the RSO.

The Department encourages all posts and tenant agencies to use secure logistics operations (SLOs) services for
U.S. Government shipments. SLOs are DS-approved, Department-controlled
operations that assist with secure procurement and coordinate secure shipments.
