Several statutory authorities provide the Department of
State contracting authority to hire personal services contractors (PSCs):
(1) For the Department, Section 2(c) of the State
Department Basic Authorities Act of 1956, as amended (22 U.S.C. 2669);
(2) For the Bureau of Population, Refugees, and
Migration, Section 5(a) (6) of the Migration and Refugee Assistance Act of
1962, as amended (22 U.S.C. 2605);
(3) For the Bureau of International Narcotics and Law
Enforcement Affairs, Section 636(a)(3) of the Foreign Assistance Act of 1961,
as amended (22 U.S.C. 2396);
(4) For the Foreign Service Institute, Section 704(a)
(4) of the Foreign Service Act of 1980, as amended (22 U.S.C. 4024);
(5) For the Office of Foreign Missions, Section 208(d)
of Title II - Authorities Relating to the Regulation of Foreign Missions, of
the State Department Basic Authorities Act of 1956, as amended (22 U.S.C. 4308);
(6) For the Bureau of Overseas Buildings Operations,
Section 5 of the Foreign Service Buildings Act, 1926, as amended (22 U.S.C.
296);
(7) For the U.S. Mission to the United Nations,
Section 7 of the United Nations Participation Act of 1945, as amended (22
U.S.C. 287e);
(8) For the Bureau of International Organization
Affairs, the separate State Department appropriations acts; and
(9) For the Bureau of Diplomatic Security, section 206
of Public Law 99-399 (22 U.S.C. 4824), as amended by the Emergency Supplemental
Appropriations Act of 1998.

The Department recognizes that PSCs are valuable members
of the workforce who regularly make contributions to the effectiveness of the
mission and U.S. diplomacy. The PSC Awards Program recognizes and rewards PSCs
individually or as a group for: performance; innovations; efforts that
contribute to efficiency, economy, or other improvements in government
operations; or special acts or services related to their official duties
performed under the contract. Such recognition may be made in the form of
performance recognition and/or cash award and awards of leave. The PSC Awards
Program is managed by each individual Department of State bureau or entity with
contracting authority to hire PSCs.
3 FAM 9123 SCOPE AND ELIGIBILITY

These regulations apply to contract U.S. citizen PSC
personnel of the Department of State.
3 FAM 9123.2 Eligibility

a. Each personal services contract initiated or renewed
after the date this program becomes effective shall include an article
entitling the PSC to receive awards pursuant to the policies provided herein.
Awards may be based only on performance by the PSC during a period in which the
contract has provided for such awards eligibility.
b. Factors impacting eligibility include:
(1) Security Each bureau executive office will
consult with bureau security staff to determine whether or not PSCs have
affirmative adjudicated security violations (12 FAM 550).
Any nominee who has received a security violation or three security infractions
during the preceding 12 months will automatically be ineligible to receive an
award. Those temporarily ineligible for an award will regain eligibility after
12 months from the date of the most recent violation or infraction; and
(2) Disciplinary action A nominee may not be
eligible to receive an award for 1 year from the date of a disciplinary action.

The Department of States PSC Awards Program is
administered under policies established by the Under Secretary for Management.
The program is planned, programmed, and publicized by bureau executive directors.
3 FAM 9123.4 Heads of Areas

a. Each Assistant Secretary of State and the heads of
offices in the following list are responsible for administering an area PSC
awards program, if applicable. The head of the area shall designate an area
awards officer, normally the executive director. The area PSC awards officer
will appoint members to serve on the area PSC awards committee. Each committee
member shall serve no more than a 2-year term per area PSC awards committee.
b. The following organizational units are authorized to
establish an area PSC awards committee and administer an area PSC awards
program:
(1) All regional and functional bureaus;
(2) Executive Secretariat;
(3) Office of the Chief of Protocol;
(4) Office of the Legal Adviser; and
(5) Office of Inspector General.
