15 FAM 1021 USAID provisions

Capital construction and major rehabilitation funded by
the U.S. Agency for International Development (USAID) follow the provisions in 15 FAM 1010
with the exceptions provided below:
(1) Authority for funding of capital construction or
major rehabilitation is derived from Section 636(c) of the Foreign Assistance
Act of 1961, as amended, or through trust funds made available by the host
government;
(2) Real property acquired with trust funds must be
for the use of USAID personnel unless a special use agreement is negotiated
with the host government;
(3) Contracting for USAID-funded or trust-funded
construction or capital improvements, including selecting architectural and
engineering (A&E) consultants, usually will be done by USAID contracting
officers using USAID contracting provisions.
When a project is constructed on
Department of State-held land, or within
Department of State property, the Bureau of Overseas Buildings
Operations (OBO) will be responsible for selection of the A&E and general contractors, and for
construction management. Any exception to this
provision must be agreed to by the Department of State and OBO;
(4) Legal documents pertaining to real property
acquired with Section 636(c) funds or
trust funds and requests for changes in USAID-funded construction or capital
improvements, must be submitted by the senior USAID officer at post to Overseas
Management Division, Office of Management
Services, Bureau for Management, USAID/Washington (USAID/W-M/MS/OMD); and
(5) Funds made available under Section 636(c) must not be used for
construction, renovation, or long-term lease of recreational facilities unless
such use is authorized or approved by USAID/W-M/MS/OMD.
15 FAM 1022 GUIDELINES FOR USAID
CONSTRUCTION
15 FAM 1022.1 General

a. USAID will obtain Bureau of Diplomatic Security (DS)
approval of capital construction and major improvement plans, specifications, drawings, and other pertinent documents. USAID/W-M/MS/OMD will coordinate with OBO for
technical review and comments, as needed.
b. USAID/W may request assistance from OBO in obtaining
architectural A&E and other services. In determining space needs, USAID
will generally follow OBOs International Code Supplement and its attachment,
and must comply with the Requirements Integration Package. Further guidance is
available in 15
FAM 640 regarding Department of State
adopted codes and permit requirements.
c. Approval and funding requests for USAID U.S.
Government-owned or leased property must be addressed to USAID/W-M/MS/OMD. For emergency projects, the
USAID mission director must contact USAID/W-M/MS/OMD regarding the information
needed.
d. Funding for A&E plans may be available and may
be requested from USAID/W, as appropriate. M/MS/OMD
will coordinate this request on the missions behalf.

Appropriations of other U.S. Government agencies may not
be charged for other than routine building maintenance,
repair, alteration, or improvement of USAID-owned property. Alterations that
are required to meet needs peculiar to the program of the using agency require
technical review and prior approval by USAID/W, DS, and OBO, as well as the
program approval and funding authorization of the agency concerned. A written
agreement between or among agencies is required to make an exception to this
rule.

a. Upon approval of a proposed major improvement by M/MS/OMD, USAID missions are authorized to
proceed in accordance with USAID procurement and contracting policies and
procedures as set forth in the Federal Acquisition Regulation (FAR), USAID's Acquisition Regulation (AIDAR), and any other related USAID
directives.
b. To request changes for USAID Section 636(c) projects, the senior USAID
officer at post must submit changes to USAID/W-M/MS/OMD,
which will coordinate with the appropriate parties.

Residence

Written approval of the USAID mission director and USAID/W-M/MS/OMD is required for any work other
than routine maintenance and repair on a USAID-owned official residence of the
USAID mission director. The USAID mission
director and USAID/W-M/MS/OMD will keep records on file for all work
orders, requisitions, and procurement documents. Prior OBO approval is
required if the residence is U.S. Government-owned or leased by Department
of State.
