a. The Department selects contractors for their
knowledge and expertise in specific subject areas. Firms under contract to the
Department generally win their contracts based in part upon the education,
experience, and training of the personnel they propose.
b. In 1998 (amended in 2003), Congress authorized the
Foreign Service Institute (FSI) to provide training, on a reimbursable basis,
to employees of a U.S. person under contract to provide services to the United
States or to any employee thereof that is performing such services (see 13 FAM 641.1). These individuals are commonly referred to as
third-party contractors. The contractor may fund the training, and bureaus are
permitted to pay for the training when appropriate.
c. As stated in 13 FAM 641.2 paragraph b, tuition
charges for FSI courses designated by FSI as State-specific can be waived for
State contractors. State-specific is indicated in the Audience section of
a course description in the FSI catalog (see also 13 FAH-1 Exhibit H-631).

a. Offices that have determined it is appropriate to
provide training to third-party contractors shall prepare a memorandum to the
Contracting Officer through the Contracting Officers Representative.
b. The memorandum must include the training class(es)
recommended and the reasons why it is appropriate to provide the training. Any
training provided to third-party contractors must be in accordance with the
terms and conditions of the contract, whether the training is provided on a
reimbursable basis or not. The memorandum shall include places for the
Contracting Officer to indicate his or her approval or disapproval of the
request. The Contracting Officers Representative is responsible for notifying
the contractor of the Contracting Officers decision.

Representative Responsibilities

The Contracting Officers Representative is responsible for:
(1) Reviewing the terms and conditions of the covering
contract to determine if the training is authorized;
(2) If the training is authorized, preparing the
memorandum requesting the training, citing the section of the contract that
authorizes the training. If the contract is silent on whether such training is
authorized (e.g., at the time the contract was awarded, the need for such
training was not established or contemplated), then the memorandum must describe
the need for the training;
(3) Notifying the contractor of the Contracting
Officers decision. If the training is approved, advising the contractor that
its employee may attend the training on a space-available, reimbursable basis;
and
(4) Preparing the formal training enrollment
application for submission to FSI; applications for contractors must be in hard
copy. A copy of the memorandum indicating the Contracting Officers approval
must be attached. The Contracting Officer is not required to sign the formal
training enrollment form (Forms SF-182, Authorization, Agreement and
Certification of Training).
